This Personal Data Privacy Policy (hereinafter referred to as the Privacy Policy) applies to all information that the SofaLux online store, located on the domain name https://sofalux.shop/lashru, can receive about the User while using the online store website , programs and products of the online store.

6. OBLIGATIONS OF THE PARTIES

6.1. The user is obliged:

6.2. The site administration is obliged to:

6.2.1. Use the information received solely for the purposes specified in clause 4 of this Privacy Policy.

6.2.2. 6.2.4. Block personal data relating to the relevant User from the moment of application or request from the User or his legal representative or the authorized body for the protection of the rights of personal data subjects for the period of verification, in the event of detection of unreliable personal data or unlawful actions.

7. RESPONSIBILITY OF THE PARTIES

7.1. The site administration, which has not fulfilled its obligations, is responsible for losses incurred by the User in connection with the unlawful use of personal data, in accordance with the legislation of the Russian Federation, except for the cases provided for in paragraphs. 5.2., 5.3. and 7.2. of this Privacy Policy.

7.2. In case of loss or disclosure of Confidential Information, the Site Administration is not responsible if this confidential information:

7.2.1. Became public domain until it was lost or disclosed.

7.2.2. Was received from a third party before it was received by the Site Administration.

7.2.3. Was disclosed with the consent of the User.

8. DISPUTE RESOLUTION

8.1. Before filing a claim in court regarding disputes arising from the relationship between the User of the online store website and the Site Administration, it is mandatory to submit a claim (a written proposal for a voluntary settlement of the dispute).

8.2. The recipient of the claim, within 30 calendar days from the date of receipt of the claim, notifies the claimant in writing about the results of consideration of the claim.

8.4. The current legislation of the Russian Federation applies to this Privacy Policy and the relationship between the User and the Site Administration.

9. ADDITIONAL TERMS

9.1. The site administration has the right to make changes to this Privacy Policy without the consent of the User.

9.2. The new Privacy Policy comes into force from the moment it is posted on the online store Website, unless otherwise provided by the new edition of the Privacy Policy.

General provisions

The offer agreement is the Contractor's official proposal (offer) to conclude a contract for the provision of services for a fee (hereinafter referred to as the Services) and contains all the essential terms of the contract for the provision of services for a fee (hereinafter referred to as the Agreement).
Acceptance of the Offer Agreement is payment for the Services in the manner, amount and terms specified in the Offer Agreement.
By accepting the Offer Agreement in the manner specified in the Offer Agreement, the Customer guarantees that he is familiar with, agrees, and fully and unconditionally accepts all the terms of the Offer Agreement as they are set out in the text of the Offer Agreement.
The Customer understands that acceptance of the Offer Agreement is equivalent to concluding an Agreement on the terms and conditions set out in the Offer Agreement.
By taking actions to accept the Offer Agreement, the Customer guarantees that he has the legal rights to enter into contractual relations with the Contractor.
The offer agreement is posted on the Internet.
The offer agreement does not require sealing and/or signing by the Customer and the Contractor (hereinafter referred to as the Parties), while maintaining full legal force.

Subject of the agreement

In accordance with the terms of the Offer Agreement, the Contractor undertakes to provide the services specified in the List of Services, and the Customer undertakes to pay for the Services.
The Customer’s assignment is contained in correspondence with the Contractor in the order form

Acceptance period

The offer agreement comes into force from the moment of acceptance and is valid until the Parties fully fulfill their obligations.
The order is produced by the contractor within 10 working days, provided that all materials necessary for production are available from suppliers. From the date the funds are credited to the contractor’s account
Terms of service provision

The terms for the provision of Services are agreed upon by the Parties in correspondence. The order is manufactured by the contractor within 10 working days, provided that all materials necessary for production are available from suppliers, from the date the funds are credited to the contractor’s account
Rights and obligations of the parties

The customer undertakes:
Pay for Services in the manner, amount and terms provided for in the Offer Agreement
Promptly transfer to the Contractor all information and documentation necessary for the provision of Services.
Accept the Services provided in accordance with the terms of the Offer Agreement
Do not transfer information received from the Contractor related to the provision of Services to third parties and do not use it in any other way that could lead to damage to the interests of the Contractor.
The Contractor undertakes:
Provide Services with high quality and on time
Transfer the results of the Services provided to the Customer in accordance with the terms of the Offer Agreement
Do not transfer or show to third parties what is in the possession of the Contractor
In case of loss of original documents received from the Customer, restore them at your own expense.

The customer has the right:
Monitor the provision of Services without interfering with the activities of the Contractor.
Receive oral and written explanations from the Contractor related to the provision of Services no later than 10 working days from the date of presentation of the relevant request.
The performer has the right:
Demand payment for Services rendered.
Receive from the Customer any information necessary to fulfill its obligations under the Offer Agreement. In case of failure to provide or incomplete or incorrect provision of information by the Customer, the Contractor has the right to suspend the fulfillment of its obligations under the Offer Agreement until the required information is provided

Cost of services

The total cost of Services under the Offer Agreement is determined after approval of the order form

Payment procedure

Payment for Services under the Offer Agreement is carried out in the following order:
Prepayment of 50% of the cost of the service
Payment of the second part (50%) occurs after the provision of services for the production of the order and provision of photographs to the Customer via the Internet, before transferring the product to the company delivering the order to the Customer
Payment method under the Offer Agreement: transfer by the Customer of funds to the Contractor's bank account. The Customer's payment obligations are considered fulfilled from the moment funds are credited to the Contractor's bank account

Responsibility of the parties
For non-fulfillment or improper execution of this Offer Agreement, the guilty Party is liable in accordance with the current legislation of the Russian Federation.
  If the Application provides for payment for services based on the results of their provision and the Customer has violated the obligation to pay, the Contractor has the right to demand, and the Customer undertakes to pay the Contractor a penalty in the amount of 0.1% of the cost of services provided and not paid within the agreed period for each day of delay until the actual performance obligations.
The parties are released from liability for complete or partial failure to fulfill the relevant obligations under the Offer Agreement if such failure was a consequence of force majeure circumstances, namely: fire, earthquake, flood, typhoon, hurricane and other natural disasters, war, military actions of any nature, mass diseases (epidemics), strikes (except for enterprises of the Parties), transportation restrictions, blockades, prohibitions (embargos) or any type of restriction on exports or imports and other acts or actions of government authorities and management, as well as any other circumstances beyond the control of Parties (“force majeure” or “force majeure”). The specified circumstances must be of an extraordinary, unforeseen and unpreventable nature, arise after the conclusion of the Offer Agreement and directly affect its execution
If force majeure circumstances occur, the Party for which such circumstances occurred is obliged to notify the other Party in writing within a reasonable time, attaching supporting documents. The parties undertake to agree on the procedure and conditions for the execution of this Offer Agreement in such conditions
The Contractor is not responsible for the conditions and quality of delivery of the selected transport company. All claims regarding delivery quality are presented to the company delivering to the Customer and are described in writing upon acceptance of the cargo. Damage to the packaging is described. The cargo is unpacked with a representative of the carrier and all damage resulting from poor quality delivery of the products is described. After signing the delivery documents, the shipping company and the Contractor do not accept claims
The return of furniture of good quality made to order is not subject to return or exchange, according to Decree of the Government of the Russian Federation No. 55
The return of an Order of inadequate quality occurs in accordance with the Law “On the Protection of Consumer Rights”

Grounds and procedure for termination of the offer agreement

The Agreement may be terminated by agreement of the Parties, as well as unilaterally at the written request of one of the Parties on the grounds provided for by the Agreement and the legislation of the Russian Federation.
Termination of the Agreement unilaterally is carried out only upon the written request of the Parties within 15 calendar days from the date the Party receives such a request.
The Customer has the right to terminate the Agreement unilaterally in the following cases:
Violation by the Contractor of the terms of provision of Services, or untimely provision by the Contractor of Services under the Offer Agreement for a period of more than 10 working days, subject to payment to the Contractor of the actual costs incurred by the latter for the provision of Services.
The Contractor has the right to terminate the Agreement unilaterally in the following cases:
Violation by the Customer of payment terms for Services, or untimely payment by the Customer for Services under the Agreement for a period of more than 10 working days
Repeated (2 or more times) violation by the Customer of the obligations provided for in clause of the Offer Agreement

Resolution of disputes from the contract

Disputes arising during the execution of this Agreement are resolved through negotiations
If during negotiations, where the interested Party is the Customer, an agreement is not reached, the Customer sends a claim in writing to the address: Salavat, st. Pushkina, house 9/36, apartment 9, signed by an authorized person
The claim is sent in any of the following ways
by registered mail with acknowledgment of delivery
courier delivery. In this case, the receipt of the claim must be confirmed by a receipt from the Party (hereinafter referred to as the addressee). The receipt must contain the name of the document and the date of its receipt, as well as the surname, initials, position and signature of the person who received this document
The claim entails civil consequences for the addressee from the moment of delivery to him or his representative
The claim is considered delivered if it
arrived to the addressee, but due to circumstances depending on him, was not delivered or the addressee did not familiarize himself with it
delivered to the address indicated in the Unified State Register of Legal Entities or named by the addressee himself, even if the latter is not located at the submitted address
The claim must be accompanied by documents substantiating the demands made by the interested Party (if the other Party does not have them), and documents confirming the authority of the person who signed the claim. These documents are submitted in the form of duly certified copies. If a claim is sent without documents confirming the authority of the person who signed it, then it is considered unsubmitted and is not subject to consideration.
The Party to which the claim is sent is obliged to consider the received claim and notify the interested Party in writing about the results within 10 (ten) business days from the date of receipt of the claim
All disputes, disagreements and claims related to its conclusion, execution, violation, termination, not settled pre-trial, are subject to consideration in court at the location of the plaintiff in accordance with the procedural legislation of the Russian Federation
